Municipalities today face increased federal regulatory pressure and penalties that enforce stricter sewer repair, replacement and maintenance standards. The EPA, Office of Wastewater Management:
  • Regulates wastewater collection systems under The Clean Water Act of 1972
  • Administers National Pollutant Discharge Elimination Systems (NPDES) - the program that permits the operation of 19,000 municipal wastewater treatment plants
  • Provides more effective public notification of the occurrence of illegal sewage overflows
The EPA's New Capacity, Management, Operation and Maintenance (CMOM) Regulations:
  • Impose stricter and expanded NPDES permitting requirements by requiring communities to ensure:
    • Adequate wastewater collection and treatment capacity.
    • Incorporation of standardized operation and maintenance activities to prevent illegal sewage overflows, which often involve the rehabilitation of structurally deficient wastewater management infrastructure.
  • Directly increase the level of spending municipalities are required to earmark for sewer rehabilitation projects
