Municipalities today face increased federal regulatory pressure and penalties that enforce stricter sewer repair, replacement and maintenance standards.
The EPA, Office of Wastewater Management:
- Regulates wastewater collection systems under The Clean Water Act of 1972
- Administers National Pollutant Discharge Elimination Systems (NPDES) - the program that permits the operation of 19,000 municipal wastewater treatment plants
- Provides more effective public notification of the occurrence of illegal sewage overflows
The EPA's New Capacity, Management, Operation and Maintenance (CMOM) Regulations:
- Impose stricter and expanded NPDES permitting requirements by requiring communities to ensure:
- Adequate wastewater collection and treatment capacity.
- Incorporation of standardized operation and maintenance activities to prevent illegal sewage overflows, which often involve the rehabilitation of structurally deficient wastewater management infrastructure.
- Directly increase the level of spending municipalities are required to earmark for sewer rehabilitation projects
Recent Adoption of General Accounting Standards Board No. 34:
- Expands municipal sewer infrastructure condition assessment
- Improves sewer infrastructure maintenance decision making process
- Encourages municipal asset preservation
